These Terms of Service (“Terms”) govern access to and use of the websites, services, publishing platform, and production services operated by AIART Publishing™ and Digitograph™ Studio (“we,” “our,” or “us”).

By accessing our website, submitting artwork, purchasing or inquiring about editions, or using any of our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.

1. Scope of Services

AIART Publishing™ and Digitograph™ Studio operate a professional fine-art publishing and production platform dedicated to AI-generated and hybrid fine art. Our services may include:

• Review and curation of AI-generated artworks
• Digitograph™ image preparation, reconstruction, and production
• Archival printing and hand-embellished limited editions
• Publishing, exhibition, and sales facilitation
• Certificates of Authenticity and edition recordkeeping
• Communication with creators, collectors, galleries, and institutions

We reserve the right to modify, suspend, or discontinue any service at our discretion.

2. Eligibility

You must be at least 18 years of age to use our services.

By using our platform, you represent that:

• You have the legal authority to enter into binding agreements
• Any artwork you submit is original or lawfully created
• You hold the necessary rights to submit and authorize use of the artwork

3. Creator Submissions & Intellectual Property

a. Ownership

Creators retain full copyright ownership of their original AI-generated artworks unless otherwise stated in a separate written agreement.

Submission of artwork does not transfer ownership.

b. License for Evaluation & Production

By submitting artwork, the creator grants AIART Publishing™ and Digitograph™ Studio a limited, non-exclusive license to:

• Review and evaluate the artwork
• Perform technical preparation, reconstruction, or rendering
• Produce Digitograph™ editions when authorized

This license is strictly limited to the purposes outlined and does not permit unauthorized reproduction or resale.

c. Production & Publishing Arrangements

Final ownership, revenue sharing, and publishing rights for Digitograph™ editions depend on the specific production model selected and must be confirmed in a signed agreement prior to production.

No artwork will be commercially published without mutual agreement.

4. Digitograph™ Production Terms

Digitograph™ editions involve professional image reconstruction, large-format preparation, archival printing, surface treatments, and optional hand-embellishment.

Because of the handcrafted and archival nature of these processes:

• Visual variations may occur between editions
• Production timelines are estimates, not guarantees
• All approved productions are considered final

Digitograph™ production files, edition records, and authentication data remain protected internal records.

5. Orders, Payments & Sales

• Prices, edition sizes, and availability are determined on a per-project basis
• Payment terms are specified at the time of order or agreement
• All sales of limited-edition artworks are final, unless otherwise stated in writing
• Shipping timelines may vary due to production, handling, or carrier delays

AIART Publishing™ is not responsible for delays caused by third-party logistics providers.

6. Collector Responsibilities

Collectors agree to:

• Purchase artworks for personal or institutional use only
• Not reproduce, resell, or distribute images without authorization
• Respect copyright, edition limits, and authenticity documentation

Unauthorized reproduction or commercial use may result in legal action.

7. Website Use & Restrictions

You agree not to:

• Copy, scrape, download, or reproduce website content or images
• Circumvent security or image-protection measures
• Misrepresent affiliation with AIART Publishing™ or Digitograph™ Studio
• Use the platform for unlawful or infringing purposes

We reserve the right to restrict or terminate access for violations.

8. Confidentiality

All non-public information, including:

• Submitted artworks
• Production files
• Pricing, agreements, and internal processes

is treated as confidential and may not be disclosed without written consent.

9. Disclaimers

Our services are provided on an “as-is” and “as-available” basis.

We do not guarantee:

• Acceptance of any submitted artwork
• Commercial success or resale value
• Continuous or uninterrupted website access

Art valuation and market performance are inherently subjective.

10. Limitation of Liability

To the fullest extent permitted by law:

• AIART Publishing™ and Digitograph™ Studio shall not be liable for indirect, incidental, or consequential damages
• Total liability shall not exceed the amount paid for the specific service giving rise to the claim

11. Indemnification

You agree to indemnify and hold harmless AIART Publishing™, Digitograph™ Studio, and their affiliates from any claims arising from:

• Your submitted content
• Breach of these Terms
• Violation of intellectual property or third-party rights

12. Termination

We may suspend or terminate access to our services at any time for:

• Violation of these Terms
• Legal or regulatory requirements
• Protection of creators, collectors, or the platform

Termination does not affect existing contractual obligations.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in courts located in Orange County, California.

14. Changes to These Terms

We may update these Terms periodically. Continued use of our services after changes constitutes acceptance of the revised Terms.
